Buhari files election petition

Major General Muhammadu Buhari (rtd) of the All Nigeria Peoples Party (ANPP) and Rev Kris Okotie of the Justice Party (JP), on 20 May, filed petitions at the Federal Court of Appeal, Abuja, challenging the results of the 19 April Presidential elections.

This brings to three the number of petitions disputing the Presidential elections. The first petition was filed on 3 May by Mohammed Dikko Yusuf, Presidential candidate of the Movement for Democracy and Justice (MDJ), also at the Court of Appeal. Yusuf is demanding fresh Presidential elections.

Cited as respondents in Buhari's petition are Vice President Atiku Abubakar and the Independent National Electoral Commission (INEC). His demands include:

• An order that the election is invalid for reasons of non-compliance with substantial sections of the Electoral Act 2002
• An order that at the time of the election, President Obasanjo was not qualified to contest.

The ANPP is also contending that Presidential Obasanjo was not elected by majority of lawful votes cast in the election, and did not receive 25 percent of votes cast in two-thirds of the states of the federation and the Federal Capital Territory, Abuja, as required by the 1999 Constitution.

Like the ANPP, Okotie's Justice Party also wants the Court to declare that:

• President Obasanjo was not duly elected at the polls
• INEC did not discharge its statutory duty in compliance with Electoral Act 2002 and the 1999 Constitution
• Fresh elections be held in strict compliance with the Electoral Act 2002 and other related laws

No date had been fixed for the hearings
Meanwhile, activities for the 29 May inauguration ceremony will commence on 23 May with Juma’at prayers at the National Mosque, and will be rounded off with a thanksgiving and dedication service at the International Conference Centre, Abuja on 31 May.

Programmes lined up for the inauguration include a presidential documentary on radio and television on 26 May and a Children’s Summit on 27 May, which will hold at the International Conference Centre in Abuja.

On 28 May, Mr John Kuffour, the President of Ghana, will deliver the inaugural lecture at the ECOWAS Secretariat. The lecture will be preceded by the NEPAD Heads of States meeting in the afternoon of the same day, followed in the evening by a cultural and musical festival and fireworks display at the Eagle Square.

The swearing-in ceremony, to be witnessed by about 47 Heads of States, will take place on 29 May at the Eagle Square, followed by an inauguration banquet later in the evening.

A football match featuring the Super Eagles of Nigeria and the Black Stars of Ghana will come up at the Abuja National Stadium on 30 May, while a thanksgiving and dedication service will be held on 31 May 2003.
